Landowner Protection Law in Pennsylvania

I just received (July 2, 2007) the following item in an e-mail:

"PENNSYLVANIA: Pennsylvania "Landowner Liability Protection Act" Heading to Governor! House Bill 13, the "Landowner Liability Protection Act," is headed to the desk of Governor Edward Rendell (D) after passing the Senate 50-0. HB13 will give added protection to a landowner who either directly or indirectly invites or permits any person to use his property for recreational purposes. The landowner would not incur liability for any injury to persons or property..."

If I understand the discussion, this legislation is one that will help us negotiate HG/PG launch or landing rights with landowners. This could be very important in landowner negotiations in PA. I'm passing this on in the forum to allow the more legally knowledgeable among us to confirm and use as appropriate. (Tom McG? others?)

Members of the various PA clubs (Windriders, Daedalus, and Hyner) might pass this tidbit on to their clubs.

Now that I got you to think about the topic, I'll give you the link to the full article, which is at an NRA web site. The NRA is interested in this pending law because of how it will help hunters working with landowners. however, I believe the law is not specific to hunting, and will cover free flight, too.

Hey....if we join forces with the NRA we can get anything we want! Tell'em the FAA is trying to get us to register our aircraft and put a limit on how many we can buy in a 3 day period. The coffer doors will swing right open.

There's already one on the books in Pa. that exempts landowners from liability if they let you play on their land,there was an article on it in the Fulton County News last year sometime. It has something to do with Clean and Green tax reduction for over 10 acres in the program,allowing general public access is part of the deal.My bet is most large landowners are in the program as the tax savings are substantial.
